How to Sell a Gun in South Dakota

Identification Requirements

In South Dakota, private sellers are not required to conduct universal background checks or maintain any records for the sale, however identification is recommended if you wish to maintain a record of the transaction.

Waiting Periods

South Dakota imposes no waiting period between the time of purchase and the actual physical transfer of a firearm.

Age requirements

In South Dakota, no one under the age of 18 may possess a handgun without being in the presence of a parent, guardian or licensed firearm safety instructor. There are no age requirements for possession of long guns.

Background Checks in Private Sales

South Dakota does not require private sellers (sellers who are not licensed dealers) to initiate a background check when transferring a firearm

Ineligible Persons

Prohibited possessors are outlined in S.D. Codified Laws § 22-14-16

It is illegal to possess a firearm in South Dakota if a person:

• Has a prior conviction for a violent crime or certain felony drug crimes in the previous 15 years
• Has been convicted of felony drug crime in the previous five years
• Has a misdemeanor conviction for a domestic violence offense in the previous year
• Is a minor (under 18 years old), unless in presence of a parent or legal guardian
