How to Sell a Gun in Nebraska

Identification Requirements

Neb. Rev. Stat. § 69-2403 requires that for handguns, a Firearm Purchase Permit (issued by the sheriff in the county of one's residence) or a Nebraska-issued Concealed Handgun Permit is required.

Waiting Periods

Nebraska does not mandate a waiting period for firearm purchases, but acquiring a handgun typically requires a handgun certificate or a concealed handgun permit.

Age requirements

Neb. Rev. Stat. Section 28-1204.01 outlines the unlawful transfer of firearms to a juvenile. A person must be at least age 21 to receive a handgun purchase certificate or concealed handgun permit.

Background Checks in Private Sales

In Nebraska, background checks for long guns are not required but Neb. Rev. Stat. § 69-2403 outlines a person shall not sell, lease, rent, or transfer a handgun to a person who has not obtained a certificate.

Ineligible Persons

Neb. Rev. Stat. § 28-1206 generally prohibits the following persons from possessing firearms:

• Convicted felons
• A fugitive from justice
• Any person subject to a current domestic violence protection order, harassment protection order, or sexual assault protection order, and in knowing violation of that order
• Any person convicted within the past seven years of a misdemeanor crime of domestic violence
• Any person under the age of 25 who was previously been adjudicated an offender in juvenile court for an act which would constitute a felony or misdemeanor crime of domestic violence
